1. Introduction

Welcome to Data Driven Golf Ltd, located in Kenya. These terms and conditions govern your use of

our services and facilities. By accessing or using our services, you agree to comply with these terms.

If you do not agree, please do not use our services.

2. Services Offered

We provide a range of golf training and performance enhancement services, including but not

limited to:

• Individual coaching sessions

• Group clinics and workshops

• Fitness assessments and training

• Mental coaching and strategy sessions

• Video analysis and swing diagnostics

• Custom Fitting Services

3. Booking and Payment

All services must be booked in advance via our website or in person at the center.

Payment is required at the time of booking. Accepted payment methods include mobile money (M-

Pesa), Credit/Debit Card and bank transfers.

Prices for services are subject to change, and clients will be notified in advance of any changes.

4. Cancellation and Rescheduling Policy

Client Cancellations: Clients may cancel their bookings up to 24 hours before the scheduled session

for a full refund. Cancellations made within 24 hours will incur a 50% cancellation fee.

Rescheduling: Clients may reschedule appointments with at least 24 hours’ notice without penalty.

Requests made less than 24 hours in advance may incur a fee.

Center Cancellations: We reserve the right to cancel or reschedule sessions due to unforeseen

circumstances (e.g., weather conditions, instructor availability). Clients will be notified promptly and

offered a full refund or the option to reschedule.

5. User Responsibilities

Clients are responsible for providing accurate and truthful information during registration and

booking.

You agree to comply with all rules and regulations set forth by Data Driven Golf Ltd and to follow

instructions given by our staff during sessions.Clients are expected to conduct themselves professionally and respectfully at all times while on our

premises.

6. Acknowledgement of Risks

The Participant acknowledges and understands that participation in golfing activities, training, use

of equipment, and all related services provided at the Centre involves certain inherent risks,

including but not limited to: injury from golf balls, clubs, and equipment; the risk of physical exertion

or strain; accidents occurring on the course or premises; and injury arising from negligent or

reckless actions by other participants or parties. These risks can include serious injury or death. The

Participant voluntarily assumes all such risks, whether known or unknown.

7. Inherent Risks of Golf

The Participant acknowledges and accepts that golf is an inherently risky activity, including, but not

limited to, the risks of being struck by golf balls or clubs, falling, or sustaining other injuries due to

the unpredictable nature of the sport, and varying weather or terrain conditions. The Participant

further acknowledges the possibility of physical injury due to exertion during training or while using

equipment at the Centre.

8. Acts of God or Force Majeure

The Participant understands and agrees that the Releasees shall not be held liable for any

interruptions or cancellations of services, events, or activities at the Centre due to circumstances

beyond their control, including but not limited to natural disasters, adverse weather, acts of war,

civil disturbances, or any other event of force majeure.

9. Waiver of Liability

In consideration for being permitted to participate in activities at the Centre, the Participant hereby

releases and holds harmless Data Driven Golf Ltd, the Golf Club, and all of their respective

employees, agents, affiliates, contractors, and representatives from any and all liability, claims,

demands, or causes of action arising from or related to any injury, damage, or loss sustained during

or in connection with the Participant’s use of the facilities, equipment, or involvement in golf

activities, whether caused by negligence, the acts or omissions of others, or otherwise.

10. Indemnification

The Participant agrees to indemnify, defend, and hold harmless Data Driven Golf Ltd, the Golf Club,

and their respective officers, employees, agents, affiliates, and contractors from any and all claims,

demands, losses, costs, expenses, or liabilities arising out of or in connection with the Participant’s

use of the Centre or participation in golf activities, including legal fees and costs incurred by the

Releasees.

11. Age Requirements

Clients under the age of 18 must have parental or guardian consent to participate in our programs. A

parent or guardian must sign a liability waiver on behalf of minors.12. Privacy Policy

We are committed to protecting your privacy. Personal information collected during registration and

bookings is used in accordance with Kenyan data protection laws.

We do not sell or share your personal information with third parties without your explicit consent,

except as required by law.

13. Intellectual Property

All content and materials provided by Data Driven Golf Ltd, including training materials, videos, and

branding, are the intellectual property of Data Driven Golf Ltd. Unauthorized use or distribution is

prohibited.

14. Amendments to Terms

We reserve the right to amend these terms and conditions at any time. Changes will be posted on our

website and will take effect immediately. Continued use of our services after changes indicates

acceptance of the new terms.

15. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of

Kenya. Any disputes arising from this Agreement shall be resolved in the competent courts of Kenya.

16. Voluntary Agreement

The Participant affirms that they have read, understood, and voluntarily agreed to the terms and

conditions of this Liability Waiver and Release Agreement. The Participant also affirms that they are

of legal age (18 years or older) and have the full capacity to enter into this Agreement. If the

Participant is under 18 years of age, a parent or legal guardian must give prior consent.

17. Acknowledgement of Understanding

The Participant acknowledges that they have been given the opportunity to ask questions regarding

this waiver, and that any questions have been answered to their satisfaction. The Participant further

acknowledges that they are voluntarily assuming all risks associated with their participation in

activities at the Centre.

My introduction to the world of golf came in early 2015 leading up to the Magical Kenya Open at Karen Country Club. I understudied the superintendent where I learned a lot about the maintenance/upkeep of a golf course preparing for an international event.

2015 – This experience encouraged me to further my golf qualifications and I moved to Cupar, Scotland to do a 1-year Higher National Certificate in Professional Golf at SRUC Elmwood. Here I graduated with a diploma in professional golf (distinction) and my experience included volunteer coaching at the St Andrews Links Golf Academy, as well as experiencing playing golf at a collegiate level in the ICT League UK and the College HND team against other universities. These tournaments were all played as professional tournaments. With this new respect and insight into players at the elite level I was motivated to pursue golf as a qualified professional.

2016 – 2023 – After an initial internship with AB Golf from Elmswood I started work full time at the AB Golf High-Performance Center for owner and senior professional Adam Bishop. AB Golf is one of the busiest custom fitting, coaching and club-building outfits in the UK and is located Just outside of Oxford. Whilst here I enrolled in the University of Birmingham Professional Golf Studies FdSc Undergraduate Degree Course. I qualified in May 2020 and earned my full Class A PGA Membership. (PGA Professional)

At AB Golf, I was involved in many aspects of golf business but primarily Custom Fitting using GC Quad, Trackman and SAM Putt LAB, Coaching with Blast Motion and BodiTrack Golf Systems, Club building and repairs using a state of the art tour truck. I also gained first hand experience in running an ever expanding enterprise with 4 busy outlets (1 high performance center and 3 golf courses). A lot of experience was gained at Whiteleaf Golf Club whilst assisting the General Manager/Head professional in the day-to-day running of this golf club.

Part of my responsibilities for AB Golf was to set up and run their stand at the Annual British Golf Show. AB Golf represents most of the main brands within the golf industry here. It was here that I first met Saleem.

2023 – After 7 years with AB Golf in the UK I decided to return to Kenya to set up my own golf business. Incandescently this was at the same time that Saleem was looking to relocate to Nairobi and this led to an opportunity for both of us to jointly set up Data Driven Golf.

We intend to combine our skills, knowledge and passion for golf to create something that is a one-of-a-kind facility in Kenya based at Karen Country Club.
